      RDL· Key to Employment Law— Disciplinary System Design and Four-dimensional Governance   The China-Italy Chamber of Commerce, together with River Delta Law Firm, is glad to invite you to a one-day seminar held in Shanghai, Beijing, Suzhou, Shenzhen and Chengdu. The penalty section is a difficult part of the enterprises’ disciplinary regulations, a good penalty regulation should not only comply with the law, but also consider the reality of the employer; not only should set out different kinds of misconducts, but also specify the degree of seriousness; not only should be integrated in content, but also should leave some space of flexibility. Those balanced requirements contribute to the challenge in formulating, verifying and optimizing of the penalty rules. This one-day seminar creates four principles in formulating penalty rules, which are principle of systematization, principle of legalization, principle of reasonableness and principle of feasibility. The speaker will share with some common articles of enterprises’ penalty rules, make analysis and shed light on optimizing your own penalty rules. Course Objective: ▶ Through analyzing some real life cases and summarizing their characteristics, Specify how employers can do in order to make their penalty rules applicable to real life situations; ▶ Diagnose and evaluate the risks of some common penalty rules, point out what the potential risks are; ▶ Grasp the knowledge on how to make legal, reasonable and feasible penalty rules.      RDL• Key to Employment Law Summit— Risk Prevention & Control and Plan Implementation in the Course of Layoff The China-Italy Chamber of Commerce, together with River Delta Law Firm, is glad to invite you to a one-day seminar held in Shanghai and Shenzhen. The seminar will definitely be very helpful for HR managers to conduct layoff project. Directed at the several legal grounds for layoff in China labor law, the speakers will tell us how to terminate labor contracts through negotiations, what kind of facts can be called “the objective circumstances based on which the labor contract has been concluded have greatly changed” pursuant to Article 40 of the Labor Contract Law, as well as the procedural requirements of economic layoff pursuant of Article 41 of the Labor Contract Law. Furthermore, our speakers will use some typical cases on the aforementioned layoff methods to give the participants more vivid impression. Besides the legal provisions and real-life handling of layoff lawsuits and non-litigation projects, our speakers will share with their negotiation experience in order to realize layoff in a more harmonious way.
