IP Key – In July 2013, the European Union and the Government of the People’s Republic of China signed an Administrative Agreement about their New Intellectual Property Cooperation. The vehicle to carry out this cooperation from the European side is the IP Key Action – short for “Intellectual Property: A Key to Sustainable Competitiveness”.
The IP Key project is promoting a technical questionnaire on enforcement of °trade secrets° to collect questions by EU companies operating in China.
Trade secrets are technological or business information that (a) are unavailable to the public; (b) create economic benefits for its owner and are of practical utility; and (c) are subject to measures taken by its owner to maintain its secrecy. Violations of trade secrets are core concern for Italian companies in China and legal remedies needs to be further improved.
The questions will be sent by IP Key to the State Administration for Industry and Commerce (SAIC). SAIC’s answers will be returned to those participating in the questionnaire who leaves their email address.
Likewise, SAIC is going to draft a questionnaire on the trade secrets enforcement systems in the EU.
The purpose of this exchange is to provide EU stakeholders clear and useful state-of-the-art of China’s system for enforcement of trade secrets and engage the Chinese government in best-practices sharing for the improvement of the enforcement system in the future.
