FROM CIETAC TO SHIAC: WHAT WILL CHANGE IN DISPUTE RESOLUTION IN SHANGHAI – 27 May, Shanghai 2:00 pm
Following the split of the Shanghai branch of the China International Economic and Trade Arbitration Commission (CIETAC) from Beijing and the establishment of a new arbitration commission, the Shanghai International Arbitration Center (SHIAC), there has been much speculation about the future of dispute resolution in Shanghai. Indeed, the rules of the new commission, which came into effect on 1 May, will have different effects on the outcome of arbitration carried out between foreign companies. As SHIAC finds its feet, so too do businesses invested in Shanghai, who have hitherto relied on the mediation and arbitration powers of the former CIETAC. With the arbitration rules now in force, our clients want to know:

• What are the main changes to the rules?

• How will they affect our position in arbitration in Shanghai?

• How should we draft new and vary old arbitration clauses in our commercial contracts?


GWA Law and Tax has been following the split between CIETAC and SHIAC closely, and we invite you to an information session about dispute resolution under SHIAC commencing at 2.00pm on Monday, 27 May, at SHIAC’s address on level 7 of Jinling Mansion, 28 Jinling West Road, Shanghai. SHIAC representatives will be in attendance to answer any questions about the new rules or any other queries you may have regarding the commission.

At this event, we will look at some of the broad differences between the former commission and the new, now that SHIAC has been officially unveiled, such as:

• Consolidation of claims (article 31).

• Language of proceedings (article 60).
