RECAP | IPWG Seminar on Cimbali Group Case, 6 March

On March 6, 2025, the China-Italy Chamber of Commerce (CICC) and its Intellectual Property Working Group (IPWG) hosted the online seminar "Cimbali Group Slayer Espresso Case and Anti-Unfair Competition Law." The event provided valuable insights into the recent legal victory of the Cimbali Group Slayer espresso machine in China and explored the proposed amendments to the Anti-Unfair Competition Law (AUCL).

 

 

HIGHLIGHTS

  • Proposed Amendments of Anti-Unfair Competition Law (AUCL): Fredrick Xie, Head of Enforcement Team at Longitude Law Firm, Allasya Law & IP, provided an overview of proposed amendments to the AUCL, highlighting new provisions targeting misleading branding, commercial bribery, and unfair data practices.
  • Recent AUCL Cases: Fabio Giacopello, CICC Intellectual Property Working Group Coordinator and Managing Partner at Allasya Law & IP, shared noteworthy case studies demonstrating how businesses have navigated legal disputes under AUCL.  
  • Cimbali Group Slayer Espresso Case Study: Flavia Volpi, Legal Counsel at Cimbali Group, presented the landmark victory against counterfeiters in China. The case underscored the importance of proactive IP protection, strategic litigation, and collaborations between legal teams and enforcement agencies.A design patent challenge led to the invalidation of the infringing patent, reinforcing the value of branding and intellectual property in competitive markets.

 

 

The seminar underscored the importance of robust IP protection strategies for businesses, especially considering the evolving legal landscape in China.
